This policy explains what information Baker 1031 Investments, LLC ("Baker 1031," "we," "us") collects through baker1031.com, how we use it, and the choices you have. "We" means me, Jerry Baker, and my team.
Information you give us
When you use the Start working with Jerry form, request access, request offering documents, or book a call, we collect what you enter:
- Contact details: your name, email address, and phone number.
- About you: your role (for example investor, broker or agent, CPA or attorney), what you need help with, and any notes you add.
- Exchange and investment details: sale date, sale price, loan balance, estimated investment amount, and estimated net worth range.
- Your DST experience and goals: your knowledge of DSTs, how you're thinking about using them, what interests you, and any questions or hesitations.
- Confirmations: that you're a U.S. citizen or lawful permanent resident living in the United States, that you received and reviewed Aurora Securities' Client Relationship Summary (Form CRS), and that you understand we primarily offer DST investments.
- Call booking: the date and time you choose and anything you add when you book through Cal.com.
When you log in, we collect your email address to send you a one-time sign-in link.
Information collected automatically
- Your IP address and the date and time when you confirm you reviewed the Form CRS. We keep this as a receipt of that confirmation.
- Basic technical information that any website receives, such as your browser type, device, and pages visited, in our hosting provider's server logs.
- Cookies and local storage: sign-in cookies that keep you logged in, and small cookies that remember whether you're logged in so pages display correctly. Our own analytics (below) uses no cookies. If we turn on any of the third-party analytics tools described below, they may set their own cookies. We don't sell or rent your information.
Analytics
Our own analytics. To understand which pages are useful and whether the form works, our site records simple events: a page was viewed, the form was started or submitted, a call was booked, a calculator was used, or a document was opened. Each event stores the page address (without anything after the "?"), the website that referred you (just its domain, such as google.com), campaign tags in the link (utm_source, utm_medium, utm_campaign), your device type (mobile, tablet, or desktop), your country (from our hosting provider), and a few non-identifying details such as which calculator you used. We don't store your IP address or browser details. Instead, we combine them with the date and a secret key into a code that changes every day, so we can count daily visitors without recognizing you from one day to the next. We never record your name, email address, phone number, or what you type into forms in analytics. This uses no cookies. We keep these events for 13 months and then delete them.
Third-party tools. We may also use the following tools. Each is off unless we turn it on, none of them runs on sign-in or admin pages, and none of them loads at all if your browser sends a Global Privacy Control signal or a Do Not Track request.
- Google Analytics 4 (Google LLC) measures visits and the same events listed above. We set it to anonymize IP addresses and turn off Google signals and ad personalization. Google sets its own cookies. Learn more at policies.google.com/privacy, or install Google's opt-out add-on at tools.google.com/dlpage/gaoptout.
- Microsoft Clarity (Microsoft) shows how visitors use pages, through heatmaps and recordings of clicks, scrolling, and mouse movement. Clarity masks the text you type into form fields so it isn't recorded. Microsoft sets its own cookies. Learn more at privacy.microsoft.com.
- Microsoft Advertising (UET tag), if we run Microsoft or Bing ads, tells us when a visit from an ad leads to a form submission or booked call. Microsoft may use this to measure and improve ads. You can manage Microsoft's ad personalization at account.microsoft.com/privacy/ad-settings.
- PostHog (PostHog, Inc.) measures pages viewed and the events listed above. We don't use it to build profiles of anonymous visitors, and session recording is off. PostHog may store an anonymous identifier in a cookie or local storage. Learn more at posthog.com/privacy.
These providers process this information to give us reports, and their own privacy policies also apply.
How we use your information
- To respond to you, schedule and prepare for your call, and work with you on your 1031 exchange or investment.
- To decide whether you can see offering details on this site, and to give you access.
- To confirm your eligibility for private offerings, which are generally limited to accredited investors.
- To keep records that securities rules require, including your Form CRS confirmation.
- To keep the site secure and working, and to improve it.
Who we share it with
- Aurora Securities, Inc. (member FINRA/SIPC), the broker-dealer through which securities are offered, for account opening, suitability, supervision, and recordkeeping. Aurora's own privacy notice applies to information it holds.
- Service providers that run the site for us and may only use your information to provide their service: Vercel (hosting), Supabase (database and sign-in), Resend (email delivery), and Cal.com (scheduling), plus any of the analytics tools described above that we've turned on.
- Offering sponsors and their agents, only when you ask to invest or request documents that require it.
- Others when the law requires it, such as regulators, courts, or law enforcement, or to protect our rights or the safety of others.
How long we keep it
Analytics events are kept for 13 months and then deleted automatically. We keep the information you give us as long as we're working together and as long as securities, tax, and other laws require us to keep records, which can be six years or more. Information we no longer need is deleted.
Your choices
- You can ask us to see, correct, or delete the information we hold about you, subject to the records we must keep by law.
- You can ask us to stop contacting you at any time.
- You can clear cookies in your browser. You'll be logged out.
- To opt out of third-party analytics, turn on Global Privacy Control (built into browsers such as Firefox, Brave, and DuckDuckGo, or available as an extension) or Do Not Track in your browser settings. We honor either signal by not running Google Analytics, Microsoft Clarity, the Microsoft UET tag, or PostHog (no data is sent to them). Our own cookie-free analytics still counts the visit anonymously, as described above. You can also email us to ask us to delete analytics data.
California residents (CCPA/CPRA). You can ask what personal information we've collected about you, where it came from, how we've used it, and who we've disclosed it to. You can also ask us to correct or delete it, subject to the records we must keep by law. We don't sell your personal information, and we don't share it for cross-context behavioral advertising. If we turn on the Microsoft Advertising tag, you can opt out of any such use by turning on Global Privacy Control, which we treat as a request to opt out of sale and sharing, or by emailing us. To make any request, email hello@baker1031.com or call (415) 965-0552. We may need to confirm your identity first, and you can use an authorized agent. We won't treat you differently for making a request.
Security
We use encryption in transit, access controls, and reputable providers to protect your information. No website is perfectly secure, so please don't send account numbers or Social Security numbers through this site or by email.
Children
This site is for adults. We don't knowingly collect information from anyone under 18.
Changes
If we change this policy, we'll update the date at the top of this page.
